Delivery and stock issue

I paid for a next day delivery ($9.90) only to get it sent to me 2 weeks later because there weren't any stock available at the time I ordered which I only found out when I called a week later because I did not receive the item! It should have been clear at the beginning that items were not available and not have a default "Next Day"delivery payment that goes to my total bill when it was not going to happened. There is no offer of refund for the paid service that I did not received as well.
